Family Immigration Basics
United States immigration laws reflect a belief in the importance of uniting United States citizens and lawful permanent residents with families. To that end, the Immigration and Nationality Act (INA) has set forth several preference categories under which relatives of citizens and lawful permanent residents can immigrate. The categories are:
- Immediate Relatives of United States Citizens
- First Preference – Unmarried sons and daughters of US citizens (annual cap ~ 23,400 annually)
- Second Preference – (~114,000 annually)
- 2A – Spouses and children of LPRs (77%)
- 2B – Unmarried sons and daughters of LPRs (23%)
- Third Preference – Married sons and daughters of US citizens (~23,400)
- Fourth Preference – Brothers and sisters of adult children (~65,000)
Each preference category is subject to a complex annual numerical calculation. The quotas limit the number of visas that can be issued each year in certain preference categories. The result is some preference categories have backlogs extending many years.
