On March 2, 2011, USCIS Director Alejandro Mayorkas announced the opening of 60-day comment period on proposed changes to the H-1B petitioning process for United States employers.

On December 22, 2010, USCIS issued a final policy memorandum regarding the evaluation of evidence submitted with certain EB-1 and EB-2 petitions.

On January 27, 2011, USCIS announced that H-1B visa numbers for fiscal year 2011 were exhausted. USCIS ceased accepting H-1B applications filed under the 2011 cap that were received after January 26, 2011.
