Employment Based Green Cards: National Interest Waiver

National Interest Waivers are available to certain foreign nations seeking lawful permanent resident status (the green card) under the second preference employment based (EB-2) preference category.  A National Interest Waiver is a discretionary benefit provided by the government waiving the Labor Certification process if it is the national interest of to do so. There is a three part test for adjudicating a National Interest Waiver:

  • The beneficiary must seek to work in an area of substantial intrinsic merit
  • The beneficiary must provide a benefit that is national in scope
  • The benefit derived from the particular alien’s participation in the national interest field of endeavor must considerably outweigh the inherent national interest in protecting U.S. workers through the labor certification process.

A foreign national seeking a National Interest Waiver must document a record of past accomplishments from which it can be concluded that he or she will serve the national interest to a greater extent than other persons with the same level of education, training, and/or experience.
