Other Immediate Relatives - Children and Parents of U.S. Citizens

The first and most common family based immigration category is Immediate Relatives of United States Citizens.  Immediate relative petitions are not subject to an annual numerical limit and therefore are not subject to visa backlogs.  Immediate relatives include children, spouses, and parents of United States citizens.

Sponsoring a Parent

The parent of a United States citizen over the age of 21 is considered an immediate relative for immigration purposes.  United States citizens over the age of 21 may sponsor a biological parent or a step parent.  The relationship must be established before the son or daughter turns 18.

Sponsoring a Child

A United States citizen over 21 years of age may sponsor a child as an immediate relative.  A child is defined as an unmarried person under 21 years of age.  The definition includes stepchildren and children born out of wedlock, so long as the relationship is established before the child turns 18.

Similarly, an adopted child may be sponsored by a United States citizen so long the adoptive relationship is established before the child turns 16.
